1. Who We Are

This website and the services offered through it are operated by Fertility Advisory LLC, a limited liability company incorporated in the State of New Mexico, United States, with registered address at 412 W 7th St, Clovis, NM 88101, USA (the "Provider", "we", "us").

Fertility Advisory LLC is the Data Controller for the personal data described in this policy.

The services are led by Dr. Beatriz Rodríguez, PhD, Clinical Embryologist and Fertility Scientist. Dr. Rodríguez is a doctoral-level scientist and is not a physician.

Because we offer services to individuals located in the European Economic Area, we are subject to the EU General Data Protection Regulation under Article 3(2).

2. Information We Collect

Identity and contact data. Name, email address and telephone number provided through our contact, booking or intake forms.

Health and clinical data. Fertility and reproductive health information, medical history, prior diagnoses, treatments and protocols, laboratory results, genetic and reproductive-genetic test results, and the medical documents, reports and images you upload to us through our intake forms. This is "special category" data under Article 9 of the GDPR.

Partner data. Where you engage our services as a couple, each partner completes a separate questionnaire. Each of you provides your own data directly to us, and each of you is an individual data subject with the rights described in Section 8.

Transaction data. Payment information, processed by our payment provider. We do not store full card details.

Technical data. IP address, device and browser information, and website usage data collected through cookies and similar technologies (see Section 6).

3. How We Use Your Information

• To deliver the advisory and educational services you have booked, including the review of your case and the preparation of your written report.

• To manage bookings, send confirmations and reminders, and deliver secure video consultations.

• To respond to your enquiries.

• To send you the resources and educational or marketing communications you have specifically asked to receive.

• To operate, secure and improve the website.

• To comply with our legal, professional and insurance obligations.

4. Legal Basis for Processing

Performance of a contract (Article 6(1)(b)). To provide the services you have booked and to manage our relationship with you.

Explicit consent (Article 9(2)(a)). All processing of your health, genetic and reproductive data is carried out on the basis of your separate, explicit, opt-in consent, given at the point of submission. We never process this data without it.

Consent (Article 6(1)(a)). For marketing communications and for non-essential cookies.

Legitimate interests (Article 6(1)(f)). For essential service communications, website security, and the defence of legal claims.

Legal obligation (Article 6(1)(c)). Where retention or disclosure is required by law.

4.1 Withdrawing Your Consent

You may withdraw your consent to the processing of your health data, or to marketing, at any time and without giving a reason, by emailing beatriz@drbeatrizrodriguez.com. Withdrawal does not affect the lawfulness of processing carried out before withdrawal.

On withdrawal we will stop processing the relevant data and securely delete it, unless an overriding legal or professional retention obligation applies (see Section 7). Please note that withdrawing consent to the processing of your health data means we can no longer deliver the service.

5. Who We Share Your Data With

We do not sell or trade your personal data. We share it only with the following categories of recipient, each bound by data protection terms:

Website, booking and scheduling. Wix.com Ltd. hosts our website and operates our booking system.

Payment processing. Stripe, Inc. processes payments made through our website.

Forms, document storage and internal working files. Google LLC (Google Workspace). Our intake questionnaires, the medical documents you upload, and the working files in which your case is prepared are hosted within Google Workspace, under Google's data processing terms.

Video consultations. Zoom Communications, Inc.

Email and resource delivery. Kit (ConvertKit, Inc.), which stores your name and email address to deliver the resources and communications you have requested.

Website analytics and advertising. Meta Platforms, Inc. receives limited technical and interaction data through the Meta Pixel and Conversions API, where you have consented to non-essential cookies (see Section 6).

Clinical collaborator. Dr. Diana Valbuena (MD, PhD), Specialist in Reproductive Medicine, registered with the Spanish medical association and acting as an independent data controller in respect of her own professional assessment, subject to her own duty of medical confidentiality. Dr. Valbuena reviews your case in her medical capacity. Depending on the service and on what your case requires, her involvement may take the form of an internal clinical review of your file, direct written contact with you, or leading a consultation session with you. We tell you before you book which of these applies to your service.

Professional advisers. Our accountants, insurers and legal advisers, where necessary and under a duty of confidentiality.

 

5.1 Use of AI Tools

We use AI-assisted tools from established commercial providers to help organise and analyse case information.

Direct identifiers such as names, contact details, specific locations and dates are removed before information is processed through these tools. The resulting information is pseudonymised, not anonymised: we treat it as personal data and it remains protected as such under this policy and under applicable law.

These tools are used to support our work. They do not make decisions about you. All scientific interpretation, case review, conclusions and recommendations are produced, verified and delivered by Dr. Rodríguez and her human collaborators. No AI-generated output reaches you without expert review.

Our AI providers act as processors under contractual terms that prohibit the use of your information to train their models.

6. Cookies and Tracking

Our website uses cookies and similar technologies.

Essential cookies are necessary for the site to function, including for booking and payment, and are used without consent as permitted by law.

Analytics and advertising cookies, including the Meta Pixel, are used only where you have given consent through our cookie banner. These allow us to measure how our website is used and to show relevant content on third-party platforms. You can withdraw or change your cookie preferences at any time through the cookie settings on our website, and you can also control cookies through your browser settings.

7. Scope of Service, Confidentiality and Retention

PLEASE READ. IMPORTANT.

Our services are scientific, educational and advisory only. They do not constitute medical advice, diagnosis or treatment, and they do not create a doctor-patient relationship with Fertility Advisory LLC. All medical decisions remain between you and your treating physician.

The health information you share is treated with the highest level of confidentiality and is used exclusively to deliver your service. It is never shared with third parties for marketing purposes.

Retention. Case records and uploaded health documentation are retained for three (3) years following your last active consultation, after which they are permanently deleted or irreversibly anonymised. A longer period applies only where required by law or by the terms of our professional indemnity insurance. Contact and marketing data is retained until you unsubscribe or ask us to delete it.

8. Your Rights

Under the GDPR and comparable data protection regimes (including, where applicable, the UK GDPR, Switzerland's FADP, Brazil's LGPD, Canada's PIPEDA, Australia's Privacy Act and India's DPDP Act), you have the right to:

• access the personal data we hold about you;

• have inaccurate data corrected;

• request erasure of your data;

• object to or request restriction of processing;

• withdraw your consent at any time (Section 4.1);

• receive your data in a portable format.

You also have the right to lodge a complaint with your local data protection authority. In Spain, this is the Agencia Española de Protección de Datos (www.aepd.es).

9. International Data Transfers

Fertility Advisory LLC is established in the United States, and our services are delivered remotely from outside the European Economic Area, including from Indonesia. Our service providers are located in the United States and in the European Economic Area.

This means your personal data, including your health data, is transferred to, stored and processed outside your country of residence.

Where such transfers are subject to Chapter V of the GDPR, we rely on the safeguards recognised under applicable law, including the European Commission's Standard Contractual Clauses or, where the recipient is certified, the EU-US Data Privacy Framework. We apply appropriate technical and organisational security measures to all such transfers, including access controls, multi-factor authentication and encryption in transit and at rest.

10. Security

We restrict access to your data to those who need it to deliver your service. Access is individual and protected by multi-factor authentication. Files are not stored on personal devices or shared through public links.

11. Changes and Contact

We may update this policy to reflect changes in our practices or in legal requirements. The date at the top of this page shows when it was last revised. Material changes will be notified to you where required.
